Terms of Service — GenesUnveiled

1) Introduction

These Terms of Service (“Terms”) govern your access to and use of GenesUnveiled (the “Service”), a consumer web application that analyzes user-provided raw DNA files. Parsing runs client-side in your browser; by default, raw DNA files do not leave your device unless you choose to enable a cloud feature we may offer. By creating an account or using the Service, you agree to these Terms.

2) Who may use the Service

  • Age. You must be 18 years or older to use GenesUnveiled.

  • Account. You must provide accurate information and keep your login secure. You’re responsible for all activity on your account.

  • Territory. The Service is offered globally, with a primary focus on users in the United States and the EEA. You are responsible for compliance with local laws where you use the Service.

3) What GenesUnveiled is (and isn’t)

  • Informational use only. GenesUnveiled provides educational interpretations of your genetic data. We do not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional for medical decisions or concerns.

  • No emergency use. Do not use GenesUnveiled for emergencies or urgent health questions. Call local emergency services for immediate assistance.

  • No HIPAA relationship. GenesUnveiled is not a covered entity or business associate under U.S. HIPAA. Do not upload information you consider protected health information under HIPAA expecting HIPAA protections.

4) How processing works (client-side by default)

  • Client-side parsing. By default, raw DNA files (e.g., 23andMe/Ancestry) are parsed locally in your browser to extract a curated set of SNP genotypes for report rendering.

  • Cloud features (optional). If we offer optional cloud features (e.g., syncing, sharing, or storing your genotype subset or reports), we will present a clear, explicit consent step that describes what is stored and where. Cloud features are opt-in.

  • Your choices. You can use the Service without storing genetic data on our servers. If you opt into cloud features, you may revoke consent and request deletion at any time (see Section 11).

5) Your content & licenses

  • Ownership. You retain ownership of the raw DNA files and other content you upload (“User Content”).

  • License to operate the Service. You grant us a limited, worldwide, non-exclusive, revocable license to process and display your User Content solely to provide the Service and any optional features you enable.

  • Prohibited content. You agree not to upload malicious files, unlawful content, or genetic data of others without their explicit permission and legal authority.

6) Acceptable Use

You may not:

  • Access or use the Service in violation of law, infringe third-party rights, or facilitate discrimination or unlawful profiling.

  • Attempt to reverse engineer, scrape at scale, or bypass access controls.

  • Use automated means that degrade performance, or interfere with other users’ experience.

  • Use outputs to build competing datasets or services without our written consent.

We may suspend or terminate accounts for violations (see Section 11).

7) Accounts, plans, and payments

  • Free and paid features. We may offer free features and optional paid features (e.g., premium reports or subscriptions).

  • Payment processing. Payments (if any) are handled by a third-party processor (e.g., Stripe). You authorize us and our processor to charge your payment method for fees, taxes, and any recurring amounts.

  • Renewals. For subscriptions, billing renews automatically each period unless you cancel in your account settings before renewal.

  • Price changes. We may change prices with at least 30 days’ notice for active subscriptions.

  • Refunds / EU withdrawal right. EU/EEA consumers generally have a 14-day right of withdrawal for digital services. If you ask us to begin delivering digital content immediately (e.g., start analysis), you acknowledge losing that withdrawal right once delivery begins. Otherwise, if the service hasn’t begun, you may withdraw within 14 days. Outside the EEA, refunds are at our discretion unless required by law.

8) Privacy & data protection (GDPR/EEA focus)

  • Controller. For any personal data we process, [GenesUnveiled] is the data controller.

  • Legal bases. We rely on consent (especially for special-category genetic data), contract (to provide the Service), and legitimate interests (e.g., fraud prevention, security).

  • Genetic data requires explicit consent. We only process genetic data with your explicit consent. You can withdraw consent at any time in settings or by contacting us.

  • Cross-border transfers. If personal data is transferred outside the EEA, we will use appropriate safeguards (e.g., Standard Contractual Clauses).

  • Privacy Policy. These Terms reference and incorporate our Privacy Policy, which explains categories of data, retention, your rights (access, correction, deletion, portability, objection), and how to contact us or a supervisory authority.

9) Research citations & scientific content

We reference scientific literature and public databases. While we aim for accuracy, genetics research evolves rapidly. We do not warrant that references or interpretations are complete, current, or suitable for any medical purpose.

10) Intellectual Property (ours)

  • The Service, including software, models, UI, text, graphics, logos, and compiled reports (excluding your User Content), are owned by us or our licensors and protected by IP laws. We grant you a personal, limited, revocable, non-transferable, non-sublicensable license to use the Service for your own educational purposes. You may not copy, modify, distribute, host, or create derivative works from our IP without prior written consent.

  • If you send ideas or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them without any obligation to you.

11) Suspension & termination

We may suspend or terminate your access if: (a) you breach these Terms or applicable law; (b) your use poses security or legal risk; or (c) you fail to pay fees (if applicable). You may stop using the Service at any time. Upon termination, your right to access the Service ends.

12) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE OR RELIABLE.

13) Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) EUR 100. Nothing in these Terms limits liability that cannot be excluded under applicable law.
