Terms of Service — GenesUnveiled

1) Introduction

These Terms of Service (“Terms”) govern your access to and use of GenesUnveiled (the “Service”).

​

GenesUnveiled is operated by Klungsoyr Enterprise, org. no. 923 745 750,  Norway (“GenesUnveiled,” “we,” “us,” or “our”).

​

By creating an account, purchasing a paid feature, or otherwise using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

​

These Terms are intended to be read together with our Privacy & Security Policy, which explains how we handle personal information.

​

2) Who may use the Service

Age: You must be at least 18 years old to use GenesUnveiled.

​

Account: You must provide accurate information, keep your login credentials secure, and promptly update your account information if it changes.

​

Responsibility for your account: You are responsible for activity that occurs through your account, unless the activity results from our own fault or a security issue outside your reasonable control.

​

Local law: You are responsible for complying with the laws that apply where you use the Service.

​

3) What GenesUnveiled is — and is not

Educational and informational use only: GenesUnveiled provides educational and informational interpretations of user-provided genetic data. The Service is not intended to provide medical advice, diagnosis, treatment, or emergency guidance.

 

Not a substitute for professional care: Always seek the advice of a qualified healthcare professional for medical decisions or concerns.

 

No emergency use: Do not use GenesUnveiled for emergencies or urgent health questions. If you need urgent help, contact your local emergency services or an appropriate healthcare provider.

 

Not a medical device or clinical service: Unless we expressly state otherwise, the Service is not offered as a regulated medical device, clinical laboratory service, or healthcare service.

 

No HIPAA relationship: GenesUnveiled is not a covered entity or business associate under U.S. HIPAA. Do not send us information expecting HIPAA protections to apply.

4) How processing works

Client-side by default: GenesUnveiled is designed so that raw DNA files are parsed locally in your browser by default. In ordinary use of the Service, your raw DNA file and per-variant results do not leave your device.

 

Supported files: The Service is intended for common consumer raw DNA data formats, such as files from providers like 23andMe or AncestryDNA. We do not guarantee compatibility with every file format, every file version, or every third-party provider.

 

Local environment: Because client-side processing depends on your browser, device, operating system, and the source data you provide, the speed, availability, and outputs of the Service may vary.

5) Your content and permissions

Your ownership: You retain ownership of the raw DNA files and other content you provide to the Service (“User Content”).

 

License to operate the Service: You grant us a limited, non-exclusive, revocable license to process, display, and use your User Content only as necessary to operate the Service and any optional features you enable.

​

No broader rights than necessary: We do not claim ownership of your raw DNA file or genetic results. If your use remains entirely client-side, this license is limited to the transient technical processing needed to operate the Service on your device.

​

Your responsibility: You represent that you have the rights and authority needed to provide any User Content you submit or process through the Service.

​

Other people’s data: You must not upload, process, or share another person’s genetic data unless you have their explicit permission and any other legal authority required by applicable law.

​

6) Acceptable use

You may not:

  • use the Service in violation of applicable law

  • infringe another person’s rights or privacy

  • upload malicious code, harmful files, or unlawful content

  • attempt to bypass security measures or access controls

  • scrape, crawl, or extract data at scale from the Service

  • use bots or automated means in a way that disrupts the Service

  • reverse engineer the Service except to the extent mandatory law allows such activity

  • use the Service or its outputs to build a competing dataset, product, or service without our written consent

  • use the Service to make decisions about another person’s employment, insurance, credit, housing, or similar high-impact matters

 

We may suspend or restrict access if we reasonably believe you have violated these Terms or created legal, security, or operational risk.

7) Accounts, plans, payments, and cancellation

Free and paid features: We may offer free features and optional paid features, including subscriptions or one-time paid reports.

 

Payment processors: Payments may be handled by third-party payment providers such as Stripe or PayPal. By purchasing a paid feature, you authorize us and our payment providers to charge the payment method you provide for applicable fees, taxes, and recurring charges where relevant.

 

Billing and renewal: If you purchase a subscription, it renews automatically for the billing period shown at checkout unless you cancel before renewal.

 

Cancellation: You may cancel a subscription before the next renewal date. Unless we state otherwise at checkout, cancellation stops future renewals and your access continues until the end of the period you already paid for.

 

Price changes: We may change prices for future billing periods. If you have an active subscription, price changes will not affect your current price.

 

Non-payment: We may suspend or terminate access to paid features if payment is unsuccessful, reversed, or overdue.

 

Taxes: Where applicable, prices may include or exclude taxes, which will be shown to you at checkout as required.

Instant delivery of digital services and content: GenesUnveiled is designed to deliver digital results immediately after purchase or activation. By completing a purchase for instant-access reports, premium results, subscriptions, or other digital features that begin immediately, you expressly request immediate performance of the contract. Some reports or results may be unavailable if your DNA file does not contain the data required to generate them accurately and reliably. Because the Service is delivered digitally and results are provided immediately based on the file you submit, refunds are generally not available on this basis, except where required by applicable law.

 

EEA/UK consumer withdrawal rights: If you are a consumer in the EEA or UK and buy a digital service or digital content at a distance, you may generally have a 14-day withdrawal right. However, if you expressly request that we begin supplying the digital service or digital content during that period, and you acknowledge that you may lose the withdrawal right once performance begins where the law allows, then the withdrawal right may be lost once supply has begun to the extent permitted by applicable law.

 

Refunds: Because the Service is digital and results are delivered immediately, purchases are generally non-refundable once access has been provided or performance has begun, except where mandatory law requires otherwise. If the law gives you a withdrawal, cancellation, refund, or conformity right that cannot be excluded, these Terms do not limit that right.

8) Privacy and data protection

Our Privacy & Security Policy forms part of your use of the Service.

​

Client-side genetic processing by default: In normal use of the Service, your raw DNA file and per-variant results are processed locally on your device and are not collected or stored by us.

​

When we may process personal data: We may process account, billing, communications, device, usage, and security data in order to operate the Service, process payments, provide support, prevent fraud, and comply with law.

 

When we may process genetic data centrally: If you voluntarily send us genetic information in a support request, we may process that information only as described to you at the time and, where required, based on your explicit consent or another valid legal basis under applicable law.

 

Privacy rights: Where applicable, you may have rights to access, correct, delete, object, restrict, or receive a portable copy of certain personal data. See our Privacy & Security Policy for details.

9) Scientific content and citations

GenesUnveiled may reference scientific literature, public databases, and other informational sources.

​

Genetics research evolves over time: Associations, effect sizes, interpretations, and scientific consensus can change. Because of this, we do not guarantee that all interpretations, references, or report content will always be complete, current, or medically suitable.

 

The Service is intended to help users explore educational interpretations of genetic information, not to establish clinical conclusions.

​

10) Intellectual property

The Service, including its software, design, branding, report structure, text, graphics, user interface, and other content other than your User Content, is owned by us or our licensors and is protected by intellectual property and other applicable laws.

​

We grant you a personal, limited, revocable, non-transferable, non-sublicensable license to use the Service for your own lawful, personal, educational use.

​

You may not copy, reproduce, modify, distribute, sell, sublicense, publicly display, publicly perform, host, or create derivative works from the Service or our content, except as expressly allowed by us in writing or as required by mandatory law.

​

If you send us feedback, suggestions, or ideas, you agree that we may use them without restriction and without any obligation to compensate you.

​

11) Suspension, termination, and discontinuation

We may suspend, restrict, or terminate your access to the Service if:

  • you materially breach these Terms

  • your use creates security, fraud, legal, or operational risk

  • we are required to do so by law

  • you fail to pay applicable fees for paid features

  • we discontinue the relevant part of the Service

You may stop using the Service at any time.

​

Upon termination, your right to use the Service ends immediately, except for any rights that by their nature are intended to survive termination.

​

Termination does not automatically delete information that we are entitled or required to retain under our Privacy & Security Policy or applicable law.

​

12) Availability and changes to the Service

We may modify, update, suspend, or discontinue all or part of the Service from time to time.

​

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

​

We may release new features, remove features, or change how features work. Some features may be available only in certain regions, to certain account types, or during testing periods.

​

13) Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.”

​

We disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

​

Without limiting the above, we do not warrant that:

  • the Service will be uninterrupted, timely, secure, or error-free

  • the Service will be compatible with every raw DNA file or third-party source

  • the outputs, interpretations, or references will always be accurate, complete, current, or suitable for any particular purpose

  • defects will always be corrected

​

Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.

​

14) Limitation of liability

To the fullest extent permitted by law, we and our officers, directors, employees, contractors, licensors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business opportunity, data, goodwill, or anticipated savings, arising out of or related to your use of the Service.

​

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of:

  • the amount you paid us in the 12 months before the event giving rise to the claim, or

  • EUR 100

​

Nothing in these Terms limits or excludes liability to the extent such limitation or exclusion is not permitted by applicable law, including liability for fraud, wilful misconduct, gross negligence where applicable, death or personal injury caused by negligence where applicable, or violations of mandatory consumer rights.

​

15) Governing law and disputes

These Terms are governed by the laws of Norway, without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.

​

We encourage you to contact us first so we can try to resolve any issue informally.

 

If you are a consumer, nothing in these Terms prevents you from relying on mandatory rights or bringing a claim before a court or authority where applicable law gives you that right.

​

16) Changes to these Terms

We may update these Terms from time to time.

If we make material changes, we may provide notice by updating the date at the top of these Terms, posting a notice through the Service, emailing you, or using another reasonable method.

​

By continuing to use the Service after updated Terms take effect, you agree to the revised Terms. If you do not agree, you must stop using the Service.
